Terms

These terms are an agreement between you and Teloform governing your use of teloform.com. By using the site you accept them. If you do not accept them, do not use the site.

They apply to the website only. A benchmark engagement, and any use of a Matter Model, is governed by a separate written agreement signed with the firm. Where that agreement and these terms differ, that agreement governs.

This site is published for legal and construction professionals evaluating our work. There is no public account creation, and nothing on this site grants access to any product.

You must be able to form a binding contract to use the site, and you must use it in compliance with the laws that apply to you.

Parts of this site describe how construction disputes are argued and refer to published standards and to decided cases. That material is general reference, written to show the work we do. It is not legal advice, it is not a substitute for advice from a qualified lawyer, and it must not be relied on in a live matter.

Reading it, or contacting us through this site, does not create a lawyer and client relationship, and it does not create any duty of confidence. Do not send us privileged or confidential material through this website.

The authorities named are decisions of particular courts in particular jurisdictions. They do not state the law of every seat, they may have been overtaken, and their application always turns on facts we have not seen. Take advice on your own matter.

Nothing on this site is an offer capable of acceptance, and submitting the benchmark request form does not oblige us to accept a matter or enter an engagement. We may decline any enquiry, including for conflicts.

Descriptions of what the product does are descriptions of architecture and method. They are not performance guarantees, and they are not a warranty of any outcome in any matter.

The text, design, diagrams, brand, and marks on this site belong to Teloform or are used with permission. You may read the site, and quote from it briefly with attribution, for the purpose of evaluating our work.

You may not:

• Copy or republish substantial parts of the site as your own
• Use our name, brand, or marks in a way that suggests endorsement or affiliation
• Scrape, mirror, or systematically extract the site or its content
• Attempt to gain unauthorised access to any system connected to the site, or interfere with its operation

Photography and film are used under the Pexels License, with contributor attribution recorded in our asset records.

You are responsible for what you submit. You confirm that you are entitled to send it, that it is not privileged or confidential client material, and that it does not infringe anyone else’s rights.

We use what you submit to assess and respond to your enquiry as described in our privacy notice, and for nothing else.

We provide the site as it is. We do not promise it will be uninterrupted, error free, or continuously available, and we may change, suspend, or withdraw any part of it without notice.

The site may link to sites we do not control. We are not responsible for their content or their handling of your information.

To the fullest extent the law allows, Teloform is not liable for any indirect or consequential loss, or for loss of profit, revenue, data, or opportunity, arising from use of this website or reliance on anything published on it.

Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

These terms are governed by the laws of the Province of Ontario, Canada, and the parties submit to the exclusive jurisdiction of the courts of the Province of Ontario.

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it.

We may update these terms. The effective date above shows when the current version took effect, and continuing to use the site after a change means the updated terms apply.
